Terms of Service

By accessing or using Curious Bay's website, platform, and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services. These Terms form a legally binding agreement between you ("User", "Parent", "Guardian", or "you") and Curious Bay, Inc. ("Company", "we", "us", or "our").

Curious Bay provides 1:1 online mentorship classes for children aged 6–18 in Coding, AI, Math, Science, and English. Services include:

• Free 50-minute demo classes
• Paid subscription-based mentorship programs
• Learning management platform for scheduling, progress tracking, and communication
• Curriculum materials, assignments, and assessments

You must be at least 18 years old to create an account. By creating an account, you represent that you are a parent or legal guardian of the child(ren) enrolled. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities under your account
• Providing accurate, current, and complete information
• Promptly updating your information to keep it accurate

We reserve the right to suspend or terminate accounts for violations of these Terms.

Demo Classes: Free demo classes are limited to one per child. No credit card is required. We reserve the right to cancel or reschedule demos due to mentor availability.

Paid Programs: Pricing, billing cycles, and plan details are described on our website. All fees are in USD unless otherwise stated. Payments are processed securely via our payment partners. You authorize us to charge your selected payment method for the applicable fees.

Refunds: Refund policies are detailed in our Refund Policy page. In general, unused prepaid sessions may be refunded within 30 days of purchase, subject to terms.

Cancellations: You may cancel subscriptions at any time. Access continues until the end of the current billing period. No partial-period refunds for monthly plans.

• Classes are scheduled based on mutually agreed time slots
• Reschedule or cancel at least 24 hours before class to avoid charges
• Late arrivals (over 10 minutes) may result in forfeited session
• No-shows without notice count as used sessions
• Mentor substitutions may occur due to unforeseen circumstances

You agree not to:

• Share account credentials or allow unauthorized access
• Record, reproduce, or distribute class content without permission
• Disrupt classes, harass mentors, or engage in inappropriate behavior
• Use the platform for any illegal or unauthorized purpose
• Attempt to circumvent security or access controls
• Solicit mentors for off-platform arrangements

Violations may result in immediate suspension or termination without refund.

All content, curriculum, materials, software, trademarks, and branding ("IP") are owned by Curious Bay or our licensors. These Terms grant you a limited, non-exclusive, non-transferable license to access IP solely for personal, non-commercial educational use. You may not copy, modify, distribute, sell, or create derivative works without written permission.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Services, you consent to our data practices as described in the Privacy Policy.

Services are provided "as is" and "as available." We make no warranties regarding:

• Uninterrupted or error-free access
• Specific learning outcomes or grade improvements
• Mentor availability at all requested times
• Compatibility with all devices or networks

To the maximum extent permitted by law, Curious Bay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

You agree to indemnify and hold harmless Curious Bay, its officers, directors, employees, mentors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your access to the Services at our discretion, including for breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions that should survive termination (IP, disclaimers, limitation of liability, indemnification) will remain in effect.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes will be resolved through binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association, except for claims qualifying for small claims court.

We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

• Entire Agreement: These Terms, together with the Privacy Policy and any other referenced policies, constitute the entire agreement.
• Severability: If any provision is unenforceable, the remainder continues in effect.
• Waiver: Failure to enforce a right does not waive it.
• Assignment: We may assign these Terms; you may not without consent.
• No Agency: No agency, partnership, or joint venture is created.
